These Terms of Service (“Terms”) govern your use of the CustomSite website at customsite.online and our design and development services. By using the site or entering an agreement for services, you agree to these Terms.
1. Services
We provide custom website design, build, and optional hosting or maintenance as described in your quote, statement of work, or order. Deliverables, timelines, and fees are as agreed in writing (including email) unless we state otherwise on our pricing page for standard packages.
2. Client responsibilities
- Provide accurate information, content, and approvals on time.
- Ensure you have rights to any logos, text, and media you supply.
- Maintain payment and, where you control DNS or hosting, cooperate with handoff steps we provide.
3. Fees and payment
Build fees, deposits, and maintenance charges are as quoted. Late payment may delay work. Recurring services may be suspended for non-payment. Refunds, if any, are only as stated in your project agreement or required by law.
4. Intellectual property
After you pay agreed fees for a project, you receive the rights to the custom work we deliver for you as stated in your agreement (typically a license to use the site for your business). We may reuse general techniques, libraries, and non-client-specific know-how. Stock assets remain subject to their original licenses.
5. Third-party services
Domains, registrars, email, analytics, payment processors, and some hosting may be provided by third parties. Their terms and fees apply. We are not responsible for outages or actions of those providers outside our control.
6. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising from the site or services is limited to the amount you paid us for the specific service in the six months before the claim. We are not liable for indirect, incidental, or consequential damages.
7. Disclaimers
Our site and materials are provided “as is.” We do not guarantee specific business results, search rankings, or third-party tool behavior.
8. Termination
Either party may end a project or ongoing plan as set out in the relevant agreement. We may suspend access for breach of these Terms or abuse of our systems.
9. Governing law
These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-law rules, unless a mandatory consumer rule in your jurisdiction says otherwise.
